1. Agreement to These Terms

These Terms of Service ("Terms") govern your access to and use of Altaporta, including our website, iOS application, and related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree with these Terms, do not use the Service.

2. Eligibility and Account Responsibilities

  • You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate information and keep your account information up to date.

3. Description of the Service

Altaporta is a planning and accountability platform that may include features such as trip generation, goals, wishes, tasks, social circles, and progress tracking. Some features are available in free plans, while others require a paid subscription ("Pro").

We may add, remove, or modify features at any time.

4. AI-Generated Content and Recommendations

Parts of the Service use AI to generate plans, estimates, actions, and suggestions. AI outputs may be inaccurate, incomplete, outdated, or not suitable for your circumstances.

  • AI output is provided for informational purposes only.
  • You are responsible for independently verifying important information (including budgets, prices, and travel details).
  • The Service is not financial, legal, medical, tax, or mental health advice.
  • You should not rely on the Service for emergency or high-risk decisions.

5. User Content

You may submit content through the Service, including profile information, goals, comments, notes, images, and other materials ("User Content").

  • You retain ownership of your User Content.
  • You grant Altaporta a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display User Content as needed to operate and improve the Service.
  • You represent that you have all rights needed to submit User Content.
  • You are solely responsible for your User Content and interactions with other users.

6. Acceptable Use

You agree not to:

  • Use the Service in violation of any applicable law or regulation.
  • Upload or share unlawful, infringing, harassing, hateful, or abusive content.
  • Attempt unauthorized access to systems, accounts, or data.
  • Interfere with or disrupt the Service, including abuse of APIs or automated scraping.
  • Reverse engineer, decompile, or attempt to extract source code except where allowed by law.
  • Use the Service to develop competing products through abusive data extraction.

7. Pro Subscriptions, Billing, and Auto-Renewal

Pro features may be offered as monthly or annual auto-renewing subscriptions through third-party payment providers such as the Apple App Store and related billing platforms.

  • Subscription fees are charged to your payment method at confirmation of purchase.
  • Subscriptions renew automatically unless canceled before the renewal date.
  • Pricing, available plans, and features may change in the future where permitted by law.
  • Access to Pro features depends on successful payment and entitlement status.

8. Cancellation, Refunds, and Restores

  • You can manage or cancel your subscription through your platform account settings (for example, Apple ID settings).
  • Cancellation generally takes effect at the end of the active billing period.
  • Refunds are handled by the platform through which you purchased your subscription.
  • If you changed devices or reinstalled the app, you can use supported restore purchase tools where available.

9. Third-Party Services and Links

The Service may integrate third-party services (for example, authentication providers, cloud storage, analytics, AI providers, billing providers, and app stores). Your use of those third-party services may be subject to their own terms and policies.

We are not responsible for third-party products or services that we do not control.

10. Intellectual Property

The Service, including software, branding, design, text, graphics, and other content provided by Altaporta (excluding User Content), is owned by Altaporta or its licensors and protected by intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use.

11. Service Availability and Changes

We strive to provide a reliable service, but we do not guarantee uninterrupted or error-free operation. We may suspend, change, or discontinue any part of the Service at any time, including features and APIs.

We are not liable for delays, outages, or data loss resulting from maintenance, network failures, or events beyond our reasonable control.

12. Suspension and Termination

We may suspend or terminate your access if we reasonably believe you violated these Terms, created legal risk, or misused the Service.

You may stop using the Service at any time. Termination does not relieve you of obligations incurred before termination.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will meet your requirements or that all outputs will be accurate or complete.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALTAPORTA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO ALTAPORTA FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR $100 USD IF YOU PAID NOTHING.

15. Indemnification

You agree to indemnify and hold harmless Altaporta and its affiliates, officers, employees, and partners from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

16. Governing Law and Disputes

These Terms are governed by applicable law. Before filing a formal claim, you agree to contact us so we can attempt to resolve the issue informally.

If a dispute cannot be resolved informally, it will be resolved in the courts of competent jurisdiction, unless mandatory law requires otherwise.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may provide notice through the Service or by other reasonable means.

Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
